You must be at least 13 years old (or the age of consent in your jurisdiction) to use the Service.

By using the Service, you represent that you have the legal capacity to enter into these Terms.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information and promptly update it as needed.
• We may suspend or terminate access for suspected misuse, fraud, or security risks.

While using the Service, you agree not to:

• Violate any applicable law or regulation.
• Infringe upon the rights of others, including privacy and intellectual property rights.
• Upload or transmit malware, malicious code, or content that is unlawful, harmful, or abusive.
• Attempt to access accounts or systems without authorization, or interfere with Service integrity or performance.
• Use the Service to send unsolicited or unauthorized advertising or spam.

• Some features require a paid subscription billed by our payment processor, Stripe.
• Prices, billing intervals, and plan features are described in the Service and may change with notice.
• Unless otherwise stated, subscriptions auto-renew until canceled; you can manage or cancel at any time.
• Taxes may be added where required by law.
• Refunds are assessed case-by-case in our sole discretion unless required by law.

We integrate with third parties to operate the Service, such as Clerk (authentication), Stripe (payments), and PostHog (analytics). Your use of these services may be subject to their terms and privacy policies. We are not responsible for third-party services.

• You retain ownership of content you submit to the Service.
• By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service.
• You represent that you have the necessary rights to grant this license and that your content does not violate these Terms or applicable law.

The Service, including its design, features, and software, is owned by or licensed to Kin Casa and protected by intellectual property laws. Except for the limited rights expressly granted to you, we reserve all rights.

If you provide suggestions, ideas, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free license to use and exploit the feedback without restriction or compensation.

We may offer beta or experimental features that are provided "as is" without warranties and may be modified or discontinued at any time. Your use of beta features is at your own risk.

• You may stop using the Service at any time. You can request account deletion per our Privacy Policy.
• We may suspend or terminate access for any violation of these Terms or to protect the Service or its users.
• Upon termination, your right to use the Service ceases immediately. Certain provisions survive termination.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KIN CASA OR ITS SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO KIN CASA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Kin Casa and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your use of the Service or violation of these Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before initiating formal proceedings, you agree to try to resolve the dispute informally by contacting us atkincasaweb@gmail.com. If not resolved within 30 days, disputes will be resolved in the state or federal courts located in Delaware, USA, and you consent to personal jurisdiction and venue in those courts. Where applicable law permits, you and Kin Casa waive the right to a jury trial.

We may update these Terms to reflect operational, legal, or regulatory changes. We will post the updated Terms with a new "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance.

• Privacy: Our Privacy Policy describes how we handle your data.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign these Terms without our prior written consent.
• No Waiver: Failure to enforce any provision is not a waiver of our right to do so later.
• Entire Agreement: These Terms constitute the entire agreement between you and Kin Casa regarding the Service.
• Export: You must comply with all applicable export control laws.
• Notices: We may provide notices via the Service, email, or other reasonable means.
